Customer Terms of Service

These Terms govern your use of undercovershopper.ca (the “Service”). By creating an account or booking a mystery shop you agree to them.

1. Who we are

Undercover Shopper is operated in Canada. The Service connects business owners with vetted local mystery shoppers who visit and evaluate the business, then return a report.

2. Eligibility

You must be at least 18 years old and authorized to act on behalf of the business you’re booking shops for. You may only book shops for businesses you operate or have written permission to evaluate.

3. Bookings, pricing, taxes

  • All prices are in Canadian dollars (CAD). Applicable GST / HST / PST is calculated at checkout via Stripe Tax.
  • Payment is captured at booking. Missions begin only after payment clears.
  • If a purchase is required as part of the brief, you authorize reimbursement to the shopper up to the cap you set, with a minimum reimbursement of 50% of the estimated cost.
  • Subscription plans renew monthly until canceled in your Stripe customer portal.

4. Cancellation and refunds

  • You may cancel a mission for a full refund any time before it is assigned to a shopper. Use the “Delete” button on unpaid missions or contact support.
  • Once a shopper is assigned, the mission may be canceled but refunds are at our discretion: shoppers commit time and prepare for visits, so we may keep up to 50% of the fee to compensate them.
  • If a delivered report is materially incomplete or fraudulent, contact us within 7 days of delivery and we will re-shop or refund.

5. Acceptable use

  • You may not use the Service to evaluate a business you do not own or have written permission to evaluate.
  • You may not request that a shopper engage in illegal activity, harass staff, or solicit personal information.
  • Cannabis, alcohol, and other regulated industries: you confirm you hold valid licenses and comply with all applicable provincial regulation.
  • You may not attempt to identify, contact, or retaliate against individual shoppers based on a report.

6. Reports and your data

Reports delivered through the Service are provided for your internal business use. You may share them within your organization but may not republish or sell them. We retain the underlying data for tax and audit purposes per our Privacy Policy.

7. Independent contractors

Shoppers are independent contractors, not employees of Undercover Shopper or of you. We do not guarantee the absolute accuracy of any single shopper’s observations; we deliver reports as submitted, with our own quality-assurance overlay.

8. Disclaimers and limitation of liability

The Service is provided “as is.” To the maximum extent permitted by law, our aggregate liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

You may close your account at any time from your dashboard. We may suspend or terminate accounts that violate these Terms or the acceptable-use rules above. Past mission records remain in our archive as required for tax and audit purposes.

10. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of British Columbia.
